1. Online service for obtaining simplified invoices and information on travel paid for by bank card on board buses
Transports de Barcelona, SA (henceforth, TMB) has created an online service for obtaining simplified invoices and information on travel paid for by bank card on board buses, a service intended for registered users of the public transport service that it provides in Barcelona and its metropolitan area.
2. Background
These terms and conditions, along with any other conditions requirements or rules that may be established for specific events, ceremonies or cases, as well as TMB’s communications and instructions, shall govern the relations between TMB and users of the Bus Ticket website.
These terms and conditions require full acceptance. Users who do not expressly accept these terms and conditions, that is, who fail to click on the ‘I accept the terms and conditions’ button, cannot be a member of the Bus Ticket website.
Registrations with the Bus Ticket website are free of charge.
3. Subscription with the Bus Ticket website
Only natural persons over the age of 18 who have registered in advance can be users of the Bus Ticket website. All you need do to register is provide an email address account.
TMB reserves the right to require those who have registered with it to subsequently validate their registration, so as to effectively include them as users of the Bus Ticket website.
Usernames are always the email accounts provided. It is the users themselves who create their password.
Users of the Bus Ticket website are solely responsible for keeping their password confidential and undertake to adopt all necessary measures to keep it secret and not to disclose it to anyone else. Users are solely and exclusively responsible for the safekeeping and use, whether or not authorised, of their password by third parties.
Members are aware that access to the service by using another person’s identity or password, as well as any obtaining, use or dissemination of another person’s personal data, may constitute a legal violation and, possibly, a criminal offence.

4. Bus Ticket website services
Users of the Bus Ticket website can obtain simplified invoices and information on journeys paid for by bank card on board buses.
Notwithstanding the above, users of the Bus Ticket website are required to have entered their email address in the website’s form, located in ‘My profile’.
5. Responsibility and liability
Users of the Bus Ticket website undertake (i) to make proper and legitimate use of the services, products and advantages offered by TMB and of the contents of this website, and not to use them for illicit activities, whether of a civil, administrative, criminal or any other nature; (ii) not to violate the provisions established in these terms and conditions, legal notices and other sections of the Bus Ticket website; (iii) to comply with the instructions given by TMB and in its communications with members, and (iv) not to violate current legislation, above all the regulations on intellectual and industrial property, data protection, and rights to honour, personal and family privacy and self-image.
Users, fully indemnifying TMB, are responsible and liable for any harm or loss caused to TMB or third parties resulting directly or indirectly from their actions or omissions.
Likewise, for merely illustrative (and under no circumstances limiting or excluding) purposes, users of the Bus Ticket website undertake not to post, send or disseminate:
- Contents of a racist, xenophobic, pornographic or terrorism-apologist nature or which undermine human rights.
- Contents that promote acts that are criminal, degrading, defamatory, violent or which generally contravene legislation, morality, good customs and public order.
- Information or contents that violate fundamental rights and public liberties recognised both constitutionally and in international treaties or which are simply disruptive or anti-social, including flaming, spamming, flooding, trolling and griefing, as these terms are usually understood and used on the internet.
- Information to unauthorised third parties on usernames and passwords. Where a password reaches another user, the latter undertakes to inform TMB of this immediately.
- Information or contents that involve the infringement of intellectual and industrial property rights (including but not limited to patents, trademarks and copyright) of any companies belonging to the TMB group or third parties.
- Unauthorised or requested advertising, junk mail, chain emails, pyramid schemes, etc.
- Data programs (viruses and malware) that may damage the computer systems of the access provider, its suppliers or third-party internet users.
6. Adults
Only persons of legal age can be members of the Bus Ticket website.
7. Exemption from liability
TMB cannot control how members or users use the Bus Ticket website or its contents. It therefore takes no responsibility or liability for any harm or loss of any kind that may arise from its illegal, incorrect, inappropriate or incomplete use by users or for any failure by users to comply with these conditions of access and use or any other condition or instruction that may appear on the Bus Ticket website or any other media, regarding any of its services, advantages, products and the like, without prejudice, in any event, to the legal actions available to TMB or third parties.
TMB cannot guarantee the permanent availability or continuous functioning of the Bus Ticket website or the information, content, programmes, materials or products included on it.
TMB is therefore exempted from any harm or loss of any kind that may arise from any lack of availability or continuity in the functioning of the Bus Ticket website or its services or use that may be made of it by users or third parties.
In any case, TMB will do everything possible to keep the Bus Ticket website continuously available.
TMB likewise takes no responsibility or liability for any possible safety errors or deficiencies that may be caused by the user’s use of a browser in an outdated or unsafe version or by the activation of key storage devices or identification codes of registered users in the browser or for any harm, errors or inaccuracies that may arise from improper use or functioning.
Users accept that the Bus Ticket website has been created and developed in good faith by TMB with information from internal and external sources and that TMB offers it in its current state to users, despite the fact that it may include inaccuracy or errors. Users therefore release TMB from any responsibility or liability regarding reliability or utility or for any false expectations that the website may give them while browsing.
Should a user cause any kind of harm or loss to third parties, that user shall be solely responsible and liable for it. Users shall likewise keep TMB fully indemnified for any expenses, costs and, where appropriate, compensation that may arise from any legal proceedings resulting from non-compliance with these terms and conditions and the applicable regulations.
As regards purchases of discounted products or services through third party platforms, TMB shall not be responsible for either the functioning or the obligations assumed by the user with that platform.

Links to other websites of entities not belonging to TMB have been or may be included on the Bus Ticket website. TMB does not therefore assume any responsibility or liability for their contents or for any products or services they offer or for any possible viruses and malware they may contain.
Users are strictly forbidden from making changes that may affect their contents, such as links.
Also prohibited are links to this website from websites or other media that are contrary to legislation, morality or public order, or which undermine the good name or image of any of the companies belonging to the TMB group or of any of its distinctive signs.
Links to any of the pages of this website that do not contravene those prohibitions must be arranged in such a way that users are aware that they are accessing this website. In addition, if necessary, the URL for linked page must appear on their browser.
9. Intellectual and industrial property
All content on the Bus Ticket website (including but not limited to databases, images, drawings, graphs, text files, maps, trademarks, banners, interfaces, software and their various source codes, audios and videos), as well as the website itself as a visual display, are the property of TMB or its content suppliers, having been, in the latter case, licensed or assigned by them, and are protected by domestic and international intellectual and industrial property rules. The compilation (understood here as the compilation, design, organisation and assembly) of the entire content on the website is the exclusive property of TMB.
All software used in the use and development of the Bus Ticket website is the property of TMB or its software suppliers, and is protected by domestic and international intellectual and industrial property legislation.
Unless they receive prior authorisation in writing from TMB, holders of the intellectual property rights or any other owner of the contents, users are prohibited, for illustrative, non-limiting purposes, from carrying out the following regarding both the website and its contents:

Force majeure is understood for illustrative but non-limiting purposes as: a) any event that is impossible to foresee or which, whether foreseen or foreseeable, is inevitable; b) errors in access to TMB’s various webpages; c) interrupted online or telephone service; d) harm or loss caused by third parties or attacks on the website’s server (virus) that affect the quality of the services and which are not attributable to TMB or the user; e) errors in the transmission, dissemination, storage or delivery to third parties of the website’s products and contents; f) problems or errors in third-party reception, obtaining or access; g) fires; h) floods or earthquakes; i) strikes or labour disputes or other social disturbances that interfere with the supply of the products and, therefore, with compliance with the obligations accepted by TMB; j) the scarcity or unavailability of fuel; k) accidents; l) armed conflicts; m) trade or any other embargoes; n) blockade; o) disturbances, or p) any government measure.
Administrative and management errors are not considered as cases of force majeure.
11. Amendments to terms and conditions
TMB reserves the right to amend (including eliminating or adding) any part of these terms and conditions at any time.
Unless expressly decided otherwise, changes will take effect as soon as they are published, but will not affect any rights of users that are already recognised.
12. Unsubscribing from the Bus Ticket website
Members can unsubscribe from the Bus Ticket website by accessing their personal area on it.
Exercising the right to erase personal data automatically implies a request to unsubscribe from the Bus Ticket website.
TMB may unsubscribe any user of the Bus Ticket website who fails to comply with its terms and conditions in force at any time.
13. Applicable law and jurisdiction
These terms and conditions shall be interpreted and governed in accordance with Spanish legislation.
Any legal issue arising from the interpretation or performance of these terms and conditions shall be dealt with by the corresponding competent courts and tribunals in accordance with current legislation.
