How to lodge a statement
A statement is a reasoned explanation, justified with supporting documents of why you consider that you were exempt from producing a valid ticket or travel card at the time of the inspection.
You should submit your arguments and documents in a single step. Once you have received a response, you may not submit new documents or new statements.
Bear in mind that making a statement does not halt the deadline for payment, so you would be advised to pay the penalty fare and lodge your statement within the following 30 calendar days.
If your statement is accepted, the proceedings will be closed and, if you have paid, you will be asked to provide details for the amount to be refunded.
If your statement is not accepted, the fraud proceedings will continue and, if you have not paid the penalty fare within 30 calendar days, the Authorities may initiate proceedings and impose a fine of up to €600.
You have 20 days as of the date of inspection to lodge your statement. If you paid the penalty fare on the spot (and received a 50% reduction), your file is closed and you can not lodge a statement. If you were under 18 at the time of the inspection and did not pay on the spot, you likewise have 20 calendar days in which to pay.
Along with the statement form, you must submit the following scanned documents:
- The ID card, NIE or passport of the person inspected
- The inspection slip (recommended).
- Photocopy of front and back of the travel card or ticket you showed the inspector (if appropriate).
- All documents that provide proof of the facts stated on the statement form.
If the statement is lodged in regard to fraud proceedings brought against a minor, you should also provide proof that you are the child's parent or legal guardian.
Statements against the imposing of penalty fares can be submitted using the statement form. When filling in the form, you must give your case number, the first piece of information you will be asked to provide.
The case number is at the top of the inspection slip. It starts with 20 if the inspection took place in the metro and, with 10, if it was on a bus.
If you have received a notification letter, it is in the upper left corner. It starts with 20 or 40 if the inspection took place in the metro and, with 10, if it was on a bus.
Pursuant to Article 5 of Organic Law 15/1999, of 13 December, on personal data protection (LOPD) you are informed that the data obtained in the course of ticket inspections is included in an infractions file property of Metro (Ferrocarril Metropolità de Barcelona, SA) or bus (Transports de Barcelona, SA), for the purposes of administering proceedings for fraud or uncivilised behaviour. Such data may be transferred to the competent administrative or public authorities for the processing of the corresponding penalty.
